Appeal from special term, New York county. Action by Louisa Williams and others against Samuel D. Folsom and others. An order was made for the examination of defendants before trial, and from ail order denying a motion to vacate the former order defendants appeal. For former reports, see 3 N. Y. An order was heretofore made in this action for the examination of the defendants, and upon the denial of the motion to vacate it an appeal was taken to the general term, and the order was vacated because of the insufficiency of the case made in its support. 5 H. Y. Supp. 211. The case as it has been presented for the other order does not so materially differ from that previously presented as to remove it from the controlling effect of this decision.
