This action was brought by appellee to recover damages for personal injuries caused by being struck *688by appellant’s passenger-train running on the track of the Union Railway Company between Washington and Liberty streets in the city of Indianapolis.

The complaint was in three paragraphs, the first and second paragraphs allege that appellee was injured by the negligence of appellant in running said train, the third paragraph charged a wilful injury of appellee.
