BROWN, Associate Justice.

Boone & Scarborough sued W. J. Miller in the District Court of Mitchell County, in trespass to try title, to recover four sections of land situated in that county. W. J. Reiger was admitted to be the common source of title.

On the 19th day of December, 1884, Boone, Scarborough & Powell recovered judgment in the District Court of Mitchell County against W. J. Reiger for $1329, an abstract of which was duly filed and recorded in the proper office of said county on the 5th day of February, 1885.
