ORDER GRANTING MOTION FOR NEW TRIAL

HUDSPETH, District Judge.

On June 27, 1981, the Gross Manufacturing Company sponsored a company picnic at the Castner Recreation Area, Fort Bliss, Texas, a location within the special territorial jurisdiction of the United States. In the early evening, about the time the picnic was breaking up, Defendant Murrin George Castello fired two pistol shots at one Henry Villa, both of which struck the victim.
