— In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Nassau County (Murphy, J.), entered February 2, 1987, which is in favor of the respondent and against him, upon a jury verdict.

Ordered that the judgment is affirmed, with costs.

The plaintiff was injured in October of 1984 when the bus in which he was riding was struck in the rear by a vehicle driven by James Hines. The plaintiff was hospitalized for a week. His hospital records reveal that a diaphragmatic rupture was ruled out. He reentered the hospital in May of 1985 and…
