Tbe plaintiff, Ethel M. Kirkwood, began on February 27th, 1933, a suit against ber husband, Philip Milton Kirk-wood, for permanent alimony, and an allowance of temporary alimony pendente lite 'and counsel fees. Tbe ground alleged for relief was a constructiye abandonment of tbe wife by tbe husband. Tbe specific charge was that tbe defendant bad failed to support tbe plaintiff since December 28th, 1932, and had by his acts and conduct forced her to leave the marital domicile on January 4th, 1933.
