The defendant was convicted by a jury before the Honorable Howabd H. Splete, Police Justice of the Village of Carthage, New York, on September 4,1.959, of leaving the scene of accident without reporting, in violation of sub*853division 5-a of section 70 of the Vehicle and Traffic Law.
