Appellant has filed a lengthy motion for rehearing and an able brief thereon, and we have taken time to again carefully study the record and the propositions advanced by appellant; also to read the many authorities cited by appellant.

His contention that one has a right to defend against any character of assault upon him will not be questioned by us, therefore, we deem it unnecessary to discuss the numerous authorities cited, upholding the doctrine that one has a right to act in defense of his person when wrongfully assailed.
