This is an appeal from an order denying a motion to vacate and annul the petitioner’s dismissal of a condemnation proceeding and from the ensuing judgment of dismissal.

Petition for condemnation, based on a width order signed by the commissioner of highways, was filed in the district court by the state in September, 1938, for the purpose of acquiring additional right of way for trunk highway No. 19.
