Presently before the court are five appeals from the bankruptcy court. The appeals involve similar facts and identical legal issues, i.e., whether the dischargeability of a Health Education Assistance Loan (HEAL) under Chapter 13, title 11 U.S.C., is governed by 11 U.S.C. § 1328(a) or by 42 U.S.C. § 294f(g) and when during a Chapter 13 case may the government raise the dischargeability issue.
