DALTON, District Judge.

Edward B. Emmette, the claimant, brings this action under Section 205(g) of the Social Security Act, 42 U.S.C.A. § 405(g), for judicial review of the final decision of the Secretary of Health, Education and Welfare, denying claimant the establishment of a period of disability and disability insurance benefits under the Act, as amended, 42 U.S.C.A. §§ 416(i) and 423. After remand from this Court, the Appeals Council rendered the final decision of the Secretary on May 27, 1971, when it adopted the recommended decision of the hearing examiner dated May 7, 1971.
