Plaintiff, a tenant of the defendant, fell in her apartment on the second floor of the building owned by defendant. The building was a two story brick building with a flat or fairly flat, built up roof. The apartment occupied by the plaintiff was in the center of the second floor, there being three other apartments. The lower floor was occupied by the defendant in the operation of a drug store. At the time of the accident the defendant was not present, being in Florida for the winter, but one of his clerks, Fay Lazell had charge of the building and kept his books.
