The parties to this litigation are husband and wife, who, at the time of the institution of the original litigation, were not living together, but had separated. Simultaneously with the.filing of this action for unlawful de-tainer in the General Sessions Court, the 'Plaintiff filed a bill in the Chancery Court for a divorce. The Judge of the General Sessions Court overruled the plea in abatement filed by the Defendant, and rendered judgment for the Plaintiff for the possession of the property involved.
