— Reversing.

The appellant, Gr. J. Laine, hereinafter referred to as defendant, was convicted of embezzling money from a corporation while acting as its secretary and treas urer, an offense denounced by Kentucky Statutes, Section 1202, and Ms punishment was fixed at confinement in the penitentiary for one year. On this appeal he is seeking to reverse the judgment because: 1.
