FINDINGS OF FACT AND CONCLUSIONS OF LAW

KAZEN, District Judge.

Petitioner, Kevin S. Adkins, a member of the United States Navy, is currently facing court-martial on charges of unauthorized absence. On January 12,1981, the Petitioner filed this action seeking immediate release from the Navy on the grounds that it has violated its own regulations by retaining him in the military and processing him for court-martial.
