Appellant, Morris Novitsky, as administrator of the estate of Samuel Novitsky, deceased, brought suit in the superior court of Cook county against appellee, the Knickerbocker Ice Company, to recover damages for the death of his intestate. Three trials have been had. Upon the first trial the jury disagreed. Upon the second a verdict was returned for appellant and judgment was entered thereon. That judgment was reversed by the Appellate Court for the First District and the cause was remanded for another trial. (Novitsky v. Knickerbocker Ice Co. 180 Ill. App. 188.)
