The defendant was found guilty of a felonious wounding under section 1264, Revised Statutes, 1879, and was fined $100. The trial was had in the circuit court of St. Louis county, in December 1885. At the same term, and on December 23,' 1885, defendant filed his motion for new trial. Before this motion was disposed of, and while it was still pending, final judgment was rendered against him on the verdict.
