LEIBELL, District Judge.

Libelant, as the operator of the Spanish motor vessel “Motomar”, brings this suit in admiralty for the freight on respondent’s cargo of linseed, under a bill of lading issued for the transportation of the cargo from Rosario and Buenos Aires to New York in December, 1936. The amount claimed represents the full freight of $36,245.50 that would have been payable if libelant had delivered the cargo in New York. The vessel was diverted from its course to the port of Vera Cruz by order of the Spanish (Loyalist) Government and the cargo was then transferred and reshipped…
