OPINION AND ORDER

BENSON, District Judge.

I. Introduction

This tax case came on for a bench trial in the United States District Court for the District of Utah before the Honorable Dee Benson on September 7, 1994. J. Gordon Han sen appeared on behalf of plaintiff taxpayers. Kirk C. Lusty appeared on behalf of the United States.

The parties stipulated to the facts, offered into evidence joint exhibits, presented written and oral legal arguments, and submitted the ease to the Court for decision. The Court took the matter under advisement.
