GALSTON, District Judge.

This complaint charges infringement of two letters patent to Edward F. Olsen: one mechanical patent, No. 2,623,-368, issued December 30, 1952; and the other design letters patent, No. 165,-778, issued January 29, 1952. The answer denies infringement and alleges invalidity of the patents.

Both patents relate to a spill proof fluid container, and more particularly, as the patentee says in the mechanical patent, to a cover construction adapted for use upon a glass, a cup or other container with an open end to prevent accidental loss of the complete contents through…
