OPINION

NYE, Chief Justice.

The appellee brought suit for specific performance of an earnest money contract. The appellants were the owners of undivided interests in approximately eight hundred fifty-two (852) acres of land on Mat-agorda Peninsula in Matagorda County, Texas. The appellants answered appellee’s suit by a verified denial alleging fraud and deceit as their defense. The appellee filed a motion for summary judgment supported by various affidavits.
