The plaintiff in error, hereinafter referred to as the defendant, was convicted in the county court of Logan county, of cutting and injuring growing timber, and was fined $1,000 and to pay the costs. Judgment was rendered on the 26th day of October, 1929, and the case-made filed in this court on the 18th day of December, 1929.

The record in this case discloses that notice of appeal was served on the county attorney, but no notice was served on the court clerk of the county in which the defendant was tried; that no summons in error has been issued and served as provided by law, nor has the…
