Appeal by defendant from an order denying its alternative motion for judgment or a new trial.

Defendant claims that the evidence shows as a matter of law that plaintiff ivas guilty of contributory negligence.

The accident happened at a street intersection on the evening of November 10,1928; hence after dark. The intersection was brightly lighted by lights at an oil station and a street light.
