LOWE, District Judge.

Plaintiff brought this action in the Civil Court of New York, Small Claims Part, alleging that his union illegally deprived him of the proceeds of an arbitration award against his former employer. The defendants, who are both officers of plaintiff’s former union, the Communications Workers of America (“CWA” or “Union”), removed the action to this Court. Presently before the Court is plaintiff’s motion to remand and defendants’ cross-motions to dismiss or in the alternative to grant summary judgment, and for leave to file an amended petition of removal.
