This is a writ of error to a judgment in an action of trespass on the case brought in the Corporation Court of Buena Yista by the administrator of George Y. Nuckols against the Norfolk and Western Bailroad Company, to recover damages for the death of his intestate, alleged to have been occasioned by the neglignce of the defendant company. It appears that George V. Nuckols was employed as a track hand by the defendant company, and upon the morning of the accident which resulted in his death was engaged, along with others, in placing a rail upon the…
