Demand apparently exists for those professionals with the designation “CFE” on their resume. Two organizations offer the educational and training programs necessary to endow these initials with meaning. Unfortunately, whereas the defendant, the National Association of Certified Fraud Examiners, intends “CFE” to designate “Certified Fraud Examiner,” the plaintiff, the Society of Financial Examiners, has historically utilized the same initials to represent a “Certified Financial Examiner.” Whether the Lanham Act entitles the initial user of the designation to…
