MEMORANDUM OPINION AND ORDER
The question raised by defendant’s motion for judgment on the pleadings and/or summary judgment is whether the bailiff shall place the Silver Oar of the Admiralty on the bench. My answer is that the oar should be placed on the bench 1 and that this matter will procéed' as an action in admiralty and not as a case in the common law court.
