This case involves the appeal by the plaintiff below, American Canadian Expeditions, Ltd. (hereinafter referred to as “Appellant”), of the May 18, 2006, order of the Fayette County Circuit Court granting summary judgment to the defendants below, Gauley River Corporation and Mountain River Tom’s, Inc. (hereinafter referred to as “Ap-pellees”).
