There is some little discrepancy between the testimony of the plaintiff and the defendant, Joseph LeClair, as to just what was said between them a short time prior to *583the making of the first written contract, and which finally resulted in the making of that contract. The same is true as to the conversation preliminary to the second contract. There is, however, no material difference as to the substance of either of the transactions agreed upon.
