On the 21st day of April, 1916, W. A. Scoggin was killed at the station of Hodge, while serving as a hrakeman on a freight train. At the time of his death he was in the employ of appellant, the receiver of the Missouri, Kansas & Texas Railway Company of Texas. Appellee, as administra-trix, filed this suit to recover damages for herself and four minor children. The case was submitted to the jury upon special issues, resulting in a verdict and judgment in the sum of $26,000. It appears that the station of Hodge is located about four miles north of Ft.
