KOBAYASHI, J.

This is an appeal by both Joseph A. Shorba (hereinafter Shorba), appellant, cross-appellee, and the Board of Education, State of Hawaii (hereinafter Board), 1 appellee, cross-appellant.

Shorba appeals from the judgment of the trial court denying his motion for reinstatement with full back pay to his position as a tenured teacher. The Board appeals from the judgment of the trial court requiring of the Board to afford Shorba a new hearing in accordance with HRS § 297-12 (1968). 2
