SPARKS, Circuit Judge.

This appeál is from a final judgment for the defendant on the second count of plaintiff’s complaint. This count sought to recover damages under section 205(e) of the Emergency Price Control Act of 1942, as amended, 50 U.S.C.A. Appendix, § 925(e). The first count was for an injunction to restrain the defendant from violating the General Maximum Price Regulation (7 F. Reg. 3153) and Supplementary Regulation No. 14 as revised and amended (8 F.Reg. 4486, 9787), both of which were issued under section' 2(a) of the Act, 50 U.S.C.A. Appendix, § 902(a).
