(1) The charter of the city of St. Louis guarantees competition in the work of reconstructing streets, by declaring that such work shall be let to the lowest responsible bidder. Charter, art. 6, sec. 27. (2) This requirement of competition is not a mere regulation, as declared by the circuit judge in his opinion, but is a limitation of power and based upon the grayest considerations of public policy to prevent corruption and favoritism. This is an appeal from a judgment of the circuit court of the city of St. Louis, dissolving a temporary injunction which had been obtained in this cause and dismissing the bill. The suit was one in equity against the city and the board of public improvements to enjoin the said board from making a contract for the pavement of West Pine Boulevard with “bituminous macadam,” under City Ordinance No. 20822.
