Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered June 24, 1977, convicting him of arson in the third degree, upon a jury verdict, and imposing sentence. Judgment affirmed. The case is remitted to the Supreme Court, Queens County, for further proceedings pursuant to CPL 460.50 (subd 5). On May 28, 1976, at approximately 9:15 p.m., a fire occurred at Jen-West Bootery, a shoe store owned by the defendant in Jackson Heights, Queens. Neighboring stores were also engulfed by the fire.
