Plaintiff appeals as of right from the circuit court’s order granting defendants’ motion for summary disposition. We affirm in part and reverse in part.

On Tuesday, December 22, 1981, plaintiffs decedent, Center Line Police Officer William Rozenboom, was injured when he was shot by George Proper. Rozenboom later died of unrelated causes. George Proper was killed by other officers after shooting Rozenboom.
