Wright, J.), entered March 21, 1984, denying plaintiff’s motion for summary judgment in lieu of complaint, is unanimously reversed, on the law, with costs, and plaintiff’s motion for summary judgment pursuant to CPLR 3213 is granted, and judgment is directed to be entered in favor of plaintiff against defendant for $169,000.45, together with interest and costs.
