dissenting.—The suit was brought after a decision of the board of property, on the idea that the case was within the 11th section of the act of 1792. As I understand it, it is the opinion of ■the'whole court that section does not apply to or affect this case; but I leave this to a subsequent part of this opinion. The cause •was both in common pleas and here argued on all the points, and we have thought it best to give an opinion on the whole case.
