The plaintiff's are stockholders in the Atlantic and North Carolina Railroad Company. On January the-1st, 1868, the company made four hundred bonds of $500: each, with coupons attached for interest at the rate of eight per cent per annum, payable semi-annually. The principal was due and payable on January 1st, 1888. The bonds and coupons were made payable in the City of New York, and recited that they were secured by a mortgage on the Railroad, and were issued by authority of an Act of Assembly passed at the session of 1854-55.
