Plaintiff-appellant, Natural Resources Defense Council, Inc. (“NRDC”), appeals from a judgment of the United States District Court for the Southern District of New York, Charles S. Haight, Jr., Judge, dismissing NRDC’s complaint under section 304(a)(2) of the Clean Air Act (the “Act”), 42 U.S.C. § 7604 (1982)1, against Lee M. Thomas, the Administrator (the “Administrator”) of the Environmental Protection Agency (the “EPA”) for lack of subject matter jurisdiction.
