This is a civil case wherein plaintiffs National Wildlife Federation and Michigan United Conservation Clubs filed suit against defendants Carol Browner and Valdas Adam-kus of the Environmental Protection Agency (“EPA”) challenging the procedures EPA utilized in approving revisions made by the State of Michigan to its federally approved wetlands program. Count I of the Complaint alleges that EPA’s failure to commence proceedings to disapprove Michigan’s wetlands program violated a nondiscretionary duty imposed by § 404 of the Clean Water Act (“CWA”), 33 U.S.C. §…
