1. The controlling question in this case is one of title. It is a contest between an unrecorded deed executed by John Rejmolds in 1839 and the chain of titles thereunder, as set out in the abstract of title of the plaintiff in the court below, without possession, as against a deed executed to the defendant by the administrator of John Reynolds in 1911, properly executed and recorded, with possession thereunder by the defendant since October 3, 1911.
