Cook acquired the land by grant from the state, and was the common source from which both parties claimed to have derived title. The plaintiff’s chain commenced with a deed from Cook to Fergerson, dated in 1834, and recorded, on a defective probate, in 1837. The genuineness of this deed was in question. The defendants’ chain commenced with a deed from Cook’s administrator to Williams, dated and duly recorded in 1852. The action was commenced in 1858 against Herron, who died in 1870, and whose representatives have never been made parties. The Gardners were brought in as parties…
