—In a child protective proceeding pursuant to Family Court Act article 10, the Commissioner of the Administration for Children’s Services of the City of New York appeals from a fact-finding order of the Family Court, Kings County (Freeman, J.), dated April 16, 2002, which, after a fact-finding hearing, dismissed the petition.

Ordered that the order is reversed, on the law and the facts, without costs or disbursements, the petition is reinstated, a finding is made that the respondent mother neglected the subject child, and the matter is remitted to the Family Court, Kings County, for a…
