Hope v. Baltimore County

Court of Appeals of Maryland

Decided October 27, 1980No. [No. 9, September Term, 1980.]PublishedCited by 33 opinions

1Opinion of the CourtSmith, J.

We shall here hold that because Baltimore County Charter § 601 created and established a county board of appeals implementing Maryland Code (1957) Art. 25A, § 5 (U), a party aggrieved by the approval or disapproval of a subdivision plat in that county must appeal to that county’s board of appeals and may not appeal directly to the circuit court. Hence, we shall affirm the judgment of the Court of Special Appeals in Hope v. Baltimore County, 44 Md. App. 481, 409 A.2d 753 (1980), which in turn affirmed a similar determination in the Circuit Court for Baltimore County (Raine, C.J.).
