ELLIS, Presiding Judge.
Mary Bruce Mikesie, as next of friend for her husband, Anthony Mikesie, appeals from the dismissal of a medical malpractice action she filed on behalf of Mr. Mikesie in the Circuit Court of Jackson County.
*70On July 1, 1994, Mr. Mikesic, a Kansas resident, went to Trinity Lutheran Hospital for knee surgery. During surgery, Mr. Mik-esic suffered a cardiac arrest and was left severely and permanently brain damaged.
