The action was in assumpsit. The plaintiff claimed for money lent the defendant. From the evidence on the trial it appeared that the plaintiff, a life insurance agent, had secured defendant’s application for a policy of life insurance. When the policy was ready for delivery defendant did not have the money handy to pay the first premium and asked the plaintiff to advance it for him until the following month when he would pay it back. The plaintiff thereupon delivered the policy to defendant and paid the premium to the insurance company, thus putting the insurance contract…
