This appeal from a summary judgment for the defendant in a civil rights case raises two procedural issues. Appellant Griffen was a teacher in the Big Spring Independent School District whose contract was not renewed. Griffen believed this nonrenewal was racially motivated and pursued administrative remedies in the state system. These remedies were ultimately unsuccessful and Griffen filed a civil rights action in federal court.
