FINAL ORDER REGARDING EXXON’S AFFIRMATIVE DEFENSES AND PLAINTIFFS’ ENTITLEMENT TO PREJUDGMENT INTEREST

GOLD, District Judge.

THIS CAUSE is before the Court sua sponte.1 In response to Plaintiffs’ cause of action for breach of contract, Exxon raised two affirmative defenses,2 which, it contends, precludes a finding of liability as to, at least some of, Plaintiffs’ claims: (1) the statutes of limitations in the various jurisdictions bar Plaintiffs’ action as untimely3; and (2) releases affecting in excess of 5,000 dealer-members preclude the instant claim for breach of contract.
