BREWSTER, District Judge.

This is a motion to dismiss a bill of complaint brought against several respondents charged with the duty of administering the Federal Emergency! Itelief Administration and the J. P. O’Connell Company, a corporation.

The motion to dismiss being in the nature of a demurrer, the right of the complainant to the relief prayed for must appear from the allegations of facts set forth in the bill of complaint.

It is alleged that the respondents connected with the Federal Emergency Relief Administration succeeded to the powers and liabilities of the State Civil Works…
