This case comes before us for review upon certiorari. There is no settled case or bill of exceptions. Instead we have been furnished with the files of the clerk of the court below. From these the following facts appear:

On July 1, 1924, petitioner-relator (hereinafter referred to as plaintiff) executed and delivered to respondent (hereinafter referred to as defendant) a mortgage or trust deed upon certain improved real estate in Minneapolis to secure the payment of a loan of $100,000.
